  • Agreement: This document, along with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, constitutes the entire agreement between you and Factory Deals Online concerning your use of our Site and the purchase of products.

  • Governing Law: These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Protection of Personal Information Act 4 of 2013 (POPIA).

  • Company Information: Factory Deals Online is a registered private company in South Africa.

2. Use of the Website

  • You agree to use this Site for lawful purposes only. You may not use this site to post or transmit any material which is threatening, defamatory, obscene, or racially offensive.

  • You are responsible for maintaining the confidentiality of your account and password. Factory Deals Online will not be liable for any loss or damage arising from your failure to protect your account information.

3. Products and Pricing

  • We take all reasonable care to ensure that product descriptions, images, and prices are accurate. However, errors may occur. If we discover an error in the price of a product you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

  • All prices are displayed in South African Rand (ZAR) and are inclusive of Value-Added Tax (VAT).

  • Prices for our products are subject to change without notice.

4. Orders and Payment

  • Placing an item in your shopping cart does not constitute an order and does not reserve the item. An order is only complete once the checkout process has been finalised and payment has been successfully processed.

  • We reserve the right to refuse any order you place with us.

  • Payment can be made via the payment methods listed on our checkout page. All payments are processed through a secure third-party payment gateway. We do not store your full credit card details on our servers.

5. Shipping and Delivery

Our shipping and delivery procedures are governed by our Shipping Policy. Key points include:

  • A standard, flat-rate shipping fee of R150 applies to all orders delivered within South Africa.

  • We aim to deliver orders within 3-5 business days after dispatch.

  • We offer an in-store pickup option at no additional cost.

  • Once the parcel has been delivered to your nominated address and signed for, risk and ownership of the products pass to you. We are not liable for any damage or loss after this point.

6. Returns, Refunds, and Warranty

Our returns process is governed by our Returns & Refunds Policy, which is in line with the CPA. Key points include:

  • 7-Day “Change of Mind” Returns: You may return an item within 7 days for a refund or exchange, provided it is in its original, unused, and unopened condition. The cost of this return is for your account.

  • Defective Products: If a product is faulty, it can be returned within 7 days for a full refund or replacement.

  • 3-Month Warranty: All our products carry a 3-month repair warranty. If a product becomes faulty within this period, we will arrange for it to be repaired at our cost, including all associated courier fees.

7. Privacy and Personal Information

We are committed to protecting your privacy. Our collection and use of your personal information is governed by our Privacy Policy. By using our Site, you consent to the collection, storage, and use of your personal information as described therein and in accordance with POPIA.

8. Intellectual Property

All content included on this Site, such as text, graphics, logos, images, and software, is the property of Factory Deals Online or its content suppliers and is protected by South African and international copyright laws.

9. Limitation of Liability

  • This Site and its content are provided on an “as is” basis. Factory Deals Online makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, or products included.

  • In no event shall Factory Deals Online, its directors, or employees be liable for any direct, indirect, incidental, or consequential damages arising out of the use of or inability to use this website.

  • Our liability to you in connection with any product purchased is strictly limited to the purchase price of that product.

10. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The version of the Terms that will apply to your order will be those on www.factorydealsonline.co.za at the time you place your order.
